RELEASE AND WAIVER OF LIABILITY AGREEMENT I understand that there are certain inherent risks associated with participating in sports that cannot be eliminated. These risks include, but are not limited to: Minor injuries such as scratches, cuts, bruises, and strains. Major injuries such as eye injuries, infections, loss of sight, joint injuries, back injuries, heart attacks, concussions, paralysis, and even death ("Risks"). I acknowledge that these Risks may be present during sports activities hosted by Inland Empire Filipinos Sports Community (IEFSC) ("Activities") and that my participation is voluntary. 1. Assumption of Risk I voluntarily assume all risks associated with participating in the Activities, including athletic participation, use of facilities, the acts of others, and the unavailability of emergency medical care. 2. Release from Liability I release and forever discharge Inland Empire Filipinos Sports Community (IEFSC), its affiliates, partners, agents, operators, managers, employees, and representatives ("Released Parties") from any and all claims arising from my participation in the Activities, including claims resulting from negligence or any other cause. 3. Covenant Not to Sue I agree not to file or assist in any lawsuit or claim against the Released Parties for injuries, death, or property damage resulting from my participation. 4. Indemnification I agree to defend, indemnify, and hold harmless IEFSC and the Released Parties against any claims, damages, losses, or expenses arising from my participation in the Activities. 5. Governing Law This Agreement shall be governed by the laws of the State of California. 6. Waiver No provision of this Agreement may be modified unless it is in writing and signed by authorized representatives. 7. Survival Any provisions intended to survive termination of this Agreement shall remain in effect. 8. Compliance with Laws All parties agree to comply with all applicable federal, state, and local laws. 9. Severability If any part of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 10. Entire Agreement This Agreement constitutes the complete agreement between the parties and supersedes all prior agreements or communications. Any modifications must be made in writing and signed by the parties. Acknowledgment I HEREBY ACKNOWLEDGE THAT I HAVE READ, FULLY UNDERSTAND, AND AGREE TO ALL OF THE ABOVE PROVISIONS. I CERTIFY THAT I AM AT LEAST EIGHTEEN (18) YEARS OF AGE OR HAVE THE REQUIRED PARENT OR LEGAL GUARDIAN CONSENT, AND I VOLUNTARILY AGREE TO BE LEGALLY BOUND BY THIS RELEASE AND WAIVER OF LIABILITY AGREEMENT.
